When the debt is not paid by the payment date or by the end of the grace period.
A Debt Collector should be engaged once the due date on the invoice has passed, and all reasonable attempts to recover the funds have failed.
The short answer is No. However, we do work on a sliding scale commission. Therefore, the smaller the debt, the higher the commission. So, you do need to consider whether the debt is worth pursuing.
A debt can only be withdrawn if mutually agreed in writing by the Client & Debt Collector. A Withdrawal Fee does apply (please refer Notice of Appointment).
Debt Collectors are limited to the amount of times per week they are permitted to make contact with the Debtor. (3 attempts per week).
The Standard Process is as follows: 1st Letter - Letter of Demand, follow up via contact details available. 2nd Letter - Legal Action Pending, follow up via contact details available. 3rd Letter - Final Warning Legal Action (Client needs to decide whether they will be pursuing Legal Action) follow up via contact details provided. We do update and liaise with our clients on a regular basis. Note: this is the Standard Process, this may be altered to suit requirements.
No, we do not charge these fees.
Yes there are additional fees and charges for, and not limited to business searches, Landgate searches, special mail, process serving. field calls, skip tracing, legal action.
We will seek approval for all additional fees & charges.
The answer to this is - we don’t work on success rate. The reason? It all depends on the Debtor. We deal with so many different scenarios. The debtor may be a reputable business struggling with cashflow - chances of recovery - excellent. They could be a reputable business going into administration - chances of recovery- not good. They could be a Rogue Business - chances of recovery - not good. They could be an individual who does not want to ruin their Credit Rating - chances of recovery - Excellent. There are many circumstances affecting recovery potential.
The Debt Recovery Fee can only be recovered from the debtor if your (the Client‘s) Terms & Conditions state they are recoverable. These Terms & Conditions must be provided to the debtor before work is commenced.
Yes fees are charged for administrative work involved in managing payment plans.
